These Terms & Conditions ("Terms") govern your access to and use of the Tumadm mobile application and the website at tumadm.omojadata.org (collectively, the "Service"), operated by Omojadata ("we", "us"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements.
2. Accounts
- You are responsible for information you provide and for all activity on your account.
- Keep your phone number, OTP codes, and login details confidential. Notify us immediately of any unauthorised use.
- We may suspend or terminate accounts that violate these Terms, the law, or app-store policies.
3. Creator content and conduct
You retain ownership of the content you post (photos, bio, handles, messages). By posting content you grant Omojadata a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating and promoting the Service. You agree not to post content that:
- is unlawful, defamatory, harassing, hateful, or violent;
- is sexually explicit or depicts minors in any harmful context;
- infringes intellectual-property or privacy rights of others;
- contains malware, spam, or deceptive links;
- impersonates another person or misrepresents your identity.
We may remove content and/or suspend accounts that breach these rules, with or without notice.
4. Fan payments, ratings, and tips
- Fans may rate, comment on, and tip creators through the Service.
- All payments are processed by third-party providers (Mobile Money and similar). Transactions are final unless required otherwise by law or by our refund policy.
- Omojadata may deduct platform fees and processor fees before payout. Current fees are disclosed in the App.
- Creators are responsible for any taxes owed on earnings received through the Service.
- We reserve the right to hold or reverse payouts in cases of suspected fraud, chargebacks, or disputes.
5. Mandatory updates
From time to time we will release mandatory updates to maintain security, legal compliance, and app-store requirements. When a mandatory update is required, older versions may be blocked from using the Service until updated.
6. Prohibited uses
- Do not reverse-engineer, scrape, or interfere with the Service.
- Do not use the Service to send unsolicited marketing, malware, or phishing.
- Do not attempt to gain unauthorised access to other accounts or our systems.
7. Intellectual property
The Tumadm name, logo, and software are owned by Omojadata and protected by copyright and trademark law. Except for rights expressly granted in these Terms, no licence is granted to you.
8. Third-party services
The Service integrates with third-party platforms (Apple, Google, Firebase, Mobile Money providers, SMS carriers, and linked social networks). Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, Omojadata and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms will not exceed the greater of (a) the amounts you have paid us in the twelve months before the claim, or (b) USD 50.
11. Indemnity
You agree to indemnify and hold Omojadata harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if operation of the Service becomes impractical. Clauses which by their nature survive termination (IP, disclaimers, liability, indemnity, dispute resolution) will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the courts of Dar es Salaam for any dispute, except where applicable law gives you the right to your local courts.
14. Changes to these Terms
We may update these Terms. Material changes will be announced in the App or by email. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
